Request to Vacate Easement/Right-of-Way (ROW)

Property Owners sometimes request that an Easement or Right-of-Way (ROW) on or adjacent to their property be released or vacated, allowing them to build a permanent structure or utilize the land freely on that part of the property. Before an Easement or ROW may be vacated all entities with legal access to the Easement or ROW must agree that they do not need access to the property for its intended purpose.

A request to vacate/release a recorded Easement or  Right-of-Way (ROW) can be made by the property owner through Huntsville Utilities. The request will be forwarded by Huntsville Utilities to the appropriate government agency to review and officially vacate the Easement or ROW (if approved).

Easement and Right-of-Way Definitions:
Easement: A privilege to pass over the land of another, whereby the holder of the easement acquires only a reasonable use of the property, and the owner of the land retains the benefits and privileges of ownership.

Right-of-Way: A pathway or road with a specific description, or the right to cross property to go to and from another parcel.
